How does Argentina regulate crypto providers?

Last updated: · By

Argentina regulates virtual asset service providers through the PSAV registry, created by CNV General Resolution 1058. The framework defines five registration categories by activity, sets minimum capital between USD 35,000 and USD 150,000 depending on category, and requires foreign providers to incorporate locally before serving Argentine users.

What you need to know

  • The regulator is the CNV, Argentina's securities commission, not the central bank. 1
  • There are five registration categories, assigned by the activity you perform. 1
  • Minimum capital runs USD 35,000 to USD 150,000, halved for providers under USD 2.5M in annual revenue. 1
  • Foreign providers must incorporate a local company. There is no cross-border exemption. 1

Do foreign exchanges need a local entity in Argentina?

Yes. A foreign provider cannot register as a PSAV from abroad. Incorporating an Argentine company is a precondition for registration, and registration is a precondition for legally serving Argentine users. There is no passporting arrangement and no threshold below which the requirement disappears.

This is the point most expansion plans get wrong. The sequencing question is the same one every market in the region poses, and Argentina answers it more strictly than most. Teams budget for a licensing process and discover it sits behind a corporate process that takes its own time and its own advisors. The entity comes first, and everything else waits behind it.

There is a commercial argument on the other side. The same entity that satisfies the regulator is what opens local banking, and local banking is what makes fiat on-ramps and off-ramps work. Companies that treat incorporation purely as compliance cost tend to underuse it.

What capital does PSAV registration require?

Minimum capital runs from USD 35,000 to USD 150,000, with the specific figure set by the category your activity falls into. Providers generating under USD 2.5 million in annual revenue qualify for a reduced threshold at half the standard requirement for their tier.

The revenue-based reduction matters for market entry specifically: a company testing the market at low volume faces materially lower capital than the headline figure suggests. The USD 150,000 number that circulates is the top of the range, not the entry price.

What the five categories are, and why we do not list them here

Resolution 1058 defines five categories assigned by activity, and the boundaries determine which capital tier applies to you. We are not reproducing a category-by-category table because the per-category figures need to come from the text of the resolution itself, and a table that is nearly right is worse than no table when the subject is a licensing threshold.

The practical approach is the same one a local counsel will take:

1. Write down every activity you actually perform for Argentine users: custody, exchange, transfer, brokerage, payment processing. Categories follow activity, not company description. 2. Take the list to the resolution text. The CNV publishes it and the assignment is deterministic once the activities are clear. 3. Confirm the revenue threshold applies before budgeting the reduced capital. It is annual revenue, not funding raised.

Most entry plans need one or two categories, not five. The exercise is narrower than it looks.

Why the regulation is a buying trigger, not a barrier

Argentina built a registry from scratch rather than banning or ignoring the activity. For a company deciding where to allocate a regional budget, a clear rule with a defined price is easier to plan against than an unregulated market where the rules could arrive at any time.

The market behind it justifies the effort: Argentina moved USD 93.9 billion on-chain between mid-2022 and mid-2025, and ranks fourth globally in ownership at 18.9% of the population. Ninety-four percent of peso-denominated volume converts into stablecoins, which tells you the demand is for dollar access rather than speculation.

What changes the day after registration

Registration is a start date, not a finish line, and the costs that follow are recurring rather than one-off.

The obligation that surprises teams is reporting. A registered provider answers to the CNV on a schedule, in Spanish, with local documentation, and somebody has to own that calendar. This is rarely a role anyone budgeted for, and it does not go away in quiet quarters.

The second change is banking. Registration is what makes a local bank willing to open the account that fiat on-ramps and off-ramps depend on. That is the commercial upside of the whole exercise and the reason treating incorporation as pure compliance cost tends to leave value on the table.

The third is competitive. A registry with a published price is a filter. It removes the operators who were never going to invest in the market, which is uncomfortable while you are paying the entry cost and useful once you have paid it.

None of this is a reason to register early or late. It is a reason to price the second year alongside the first, and to name the person who owns the reporting calendar before the application goes in rather than after.

Argentina is the market people describe as risky and then discover is the clearest one to plan against. There is a registry, there are five categories, there is a number attached to each. Compare that with a market where the rule has not been written yet and could arrive in any quarter.

What this guide does not cover

It does not cover tax treatment, which is a separate regime and changes independently of the CNV rules. It does not cover the anti-money-laundering obligations that attach to registration, which come from a different authority. And it does not cover ongoing reporting duties after registration, which are the recurring cost most plans underestimate.

Regulatory guides age badly. This one carries a visible last-updated date for that reason. Confirm current figures against the CNV before acting on any of them.

Frequently asked questions

Can a foreign exchange serve Argentine users without registering?

No. Serving Argentine users requires PSAV registration, and registration requires an Argentine legal entity. There is no cross-border exemption and no de minimis threshold that removes the obligation. Companies operating without registration are outside the framework regardless of where their servers or staff sit.

How much capital do I actually need for PSAV registration?

Between USD 35,000 and USD 150,000, depending on which of the five categories your activity falls into. If your annual revenue is under USD 2.5 million, the requirement drops to half of your tier's figure. Determine your categories from the activities you perform before assuming the higher number applies.

Is Argentine crypto regulation a reason to avoid the market?

It is usually the opposite. A defined registry with a published price is easier to plan against than an unregulated market where rules can arrive without warning. Argentina combines that clarity with 18.9% ownership and the highest stablecoin conversion rate in the region.

How long does PSAV registration take?

There is no reliable public figure, and we are not going to invent one. Timelines depend on which categories apply, how complete the first submission is, and how long the corporate step ahead of it takes. Ask local counsel for their last three cases with dates, not an average, and budget the incorporation and the registration as two sequential processes rather than one.

Does the registry apply to self-custody wallets or DeFi front-ends?

Categories follow the activity performed for Argentine users, not the label a company uses for itself. That means the answer comes from writing down exactly what your product does (custody, exchange, transfer, brokerage, payment processing) and taking that list to the text of Resolution 1058 with local counsel. A product description is not an answer.

Can I test the Argentine market before registering?

Research, hiring and partnership conversations are not the regulated activity; serving Argentine users is. Many companies read the market, hire locally and build relationships well before they register, and that sequence is what makes the registration decision an informed one. Where the line sits for your specific product is a question for counsel, not for a guide.
